Terms of Service

These Terms govern your use of bidwitness.com and any BidWitness brief you subscribe to. By requesting a brief or subscribing, you agree to them. They are between you and Theta Work Labs LLC.

1. What BidWitness is

A weekly brief listing construction permit filings in your chosen metro that appear to have no contractor in your trade attached, with the general contractor named where the record provides one. We read public permit records and filter them to your trade and value floor. We are not a marketplace, a bidding platform, or an agent for any party.

2. Accuracy and limits — please read

Permit records are frequently wrong, late, or incomplete. Municipalities publish them unevenly. A filing may show a trade as unassigned when a contractor was already hired by phone. A general contractor's name may be missing or misfiled. A permit may be pulled or revised after we send it.

We filter and flag as carefully as we can, but we cannot verify a job is genuinely open at the moment you read it, and we do not guarantee that any listing is accurate, current, or available.

  • We do not guarantee you will win work, receive a reply, or earn any particular revenue.
  • We are not a licensing, bonding, insurance, legal, or estimating service. Verify any contractor's credentials yourself before relying on them.
  • BidWitness is not affiliated with, endorsed by, or acting for any city, county, or municipal agency.

3. Subscriptions and billing

  • Plans are $299 (Single), $599 (Multi), or $999 (Regional) per month, billed monthly in advance through Stripe.
  • Subscriptions renew automatically each month until cancelled. You are responsible for the recurring charge until you cancel.
  • Cancel any time — email hello@bidwitness.com or use the link in your receipt. Cancellation stops the next renewal; you keep access through the end of the period you paid for.
  • Your first brief is free. No payment is due before you have received it.
  • Prices may change with 30 days' notice to active subscribers, and never mid-term.

4. Refunds

Covered in full on our Refund Policy. In short: if a paid month's leads were not relevant to you, tell us within seven days of that month's brief and we refund it.

5. One subscriber per trade, per metro

We sell a given trade in a given metro to one subscriber at a time. When a slot is taken, the listing closes. If a metro has no genuinely open slots, we will tell you before you pay and will not take a subscription.

6. Your responsibilities

  • Give accurate contact details and keep them current.
  • Use your brief for your own business development. Do not resell, republish, or redistribute it, or feed it into a competing product.
  • Do not scrape, overload, or attempt to bypass access controls on this site.
  • Contact listed contractors lawfully and respectfully, and comply with telemarketing and anti-spam law in your jurisdiction.

7. Our content

The selection, filtering, scoring, trade-gap analysis, and written commentary in each brief belong to us. The underlying permit records are public. You may use the brief inside your company; you may not republish it.

8. Suspension and termination

You may stop at any time. We may suspend or end an account for non-payment, resale or redistribution, abuse, or unlawful use — and if we end it without cause, we refund the unused portion.

9. Liability

To the extent the law allows: we are not liable for indirect, incidental, or consequential losses, including lost profit, lost bids, or missed opportunities. Our total liability for any claim is limited to the amount you paid us in the three months before the claim. Nothing here limits liability that cannot lawfully be limited.

10. Indemnity

You agree to cover us against claims arising from your use of the brief, including how you contact the contractors named in it.

11. Governing law

These Terms are governed by the laws of the state in which Theta Work Labs LLC is organized, without regard to conflict-of-law rules. Disputes go to the state or federal courts located there. Before filing anything, email us — most issues are settled in one reply.

12. Changes

We may update these Terms; the effective date above changes when we do. Material changes are emailed to active subscribers at least 14 days before they take effect. Continuing after that means you accept them.
